OFFICIAL MEET & GREET AND SOUNDCHECK EXPERIENCE DRAWING RULES
Any individual ("Participant') who enters, attempts to enter or in any way participates or attempts to participate in any drawing, sweepstakes or giveaway (“Drawing”) by Kona Coast Venture, LTD. d/b/a Whitewater Music ("Whitewater") agrees to be bound by the terms and conditions provided in these Official Meet & Greet and Soundcheck Experience Drawing Rules, as well as Whitewater's interpretations of such rules. Whitewater reserves the sole right to add or modify these rules without notice.
VOID WHERE PROHIBITED
This Drawing is subject to and governed by applicable federal, state, and local laws. Participation is void outside of the U.S. and where prohibited or otherwise restricted by law.
CANCELLATION OR MODIFICATION
Whitewater reserves the right to cancel or modify the Drawing if the Drawing is not capable of being completed as planned for any reason.
NO PURCHASE NECESSARY
No purchase or separate entry is necessary to win. Additional ticket purchases do not increase your odds of selection.
ELIGIBILITY
Drawing is open to all legal U.S. residents who already hold a ticket to either the June 28 or June 29, 2024 concert event prior to the drawing on Monday, June 24, 2024.
HOW TO ENTER
All ticket holders are automatically entered to win the Meet & Greet and Soundcheck Experience. A total of 36 different, individual ticket holders will be selected at random from the ticket platform's Records list for each event and are eligible to bring a guest with them to the experience, however, the guest must possess a valid concert ticket for entry into the venue. Purchasing additional tickets to an event do not increase your odds of winning. Participants who engage or attempt to engage in fraudulent or false acts in connection to Drawing will be disqualified.
RELEASE OF LIABILITY AND INDEMNIFICATION
As consideration for entering a Drawing, Participant agrees to release, discharge, and covenant not to sue Whiteawater or the other Drawing entities noted above and each of their respective direct and indirect affiliates, divisions, parent and subsidiary companies, officers, employees, shareholders, representatives, managers, members, directors, owners, agents, insurers, attorneys, predecessors, successors, and assigns thereof (collectively, the “Released Parties”), from and against all claims, damages, charges, injuries, losses, proceedings, suits, actions (including but not limited to tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating in any manner to their participation in the Drawing, including, but not limited to, any claim that the act or omission complained of was caused in whole or in part by the strict liability or negligence in any form of the Released Parties.
Further, Participant agrees to indemnify, defend, and hold harmless the Released Parties in any action or proceeding from and against all claims, damages, charges, injuries, losses, proceedings, suits, actions (including but not limited to tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating in any manner to their participation in the Drawing or for their failure to comply with the terms of the above release provision.
ODDS OF WINNING & PRIZES
The odds of winning depends on the number of ticket holders for each event. 36 ticket holders will be selected at random for June 28 and June 29, 2024 events with a value not to exceed $250.00. The Experience location will be at Whitewater's sole discretion and in accordance with federal, state, and local laws, and venue policies. No substitution or cash equivalent will be made, and no transfer or assignment of the experience is permitted. Whitewater reserves the right to provide an alternative and equal-value prize if the experience is unavailable for any reason. If a cancellation or reschedule occurs, Whitewater has no obligation to reimburse, refund, or otherwise substitute.
WINNER SELECTION & WINNER LIST
Winners will be selected at random from all ticket holders in the the Tixr ticketing platform system and will be contacted via email on Monday, June 24 between the hours of 10:00 AM and 5:00 PM Central Standard Time. If a winner is unable to be contacted, Whitewater reserves the right to award the upgrade to an alternate winner. All winners will be given instructions on the Meet & Greet and Soundcheck Experience upon winning notification. Winners will be required to provide a valid government-issued photo identification for verification and redemption of prize, or Whitewater may deny a winner the Experience. Failure to claim the Experience prize will result in forfeiture of the prize. Failure to appear to the Experience within the noted timeframe will result in forfeiture of the prize and no other accommodations will be made. Whitewater reserves the sole right to award unclaimed Experiences to an alternate winner. Any costs relating to redeeming the Experience, including the cost of concert admission, are the sole responsibility of the winner. If a selected winner does not wish to participate in the Experience, they may decline the prize. DISQUALIFICATION
Participants agree to be bound by these official upgrade rules and non-compliance may result in disqualification. Whitewater reserves the right to disqualify Participants who engage in deceptive, fraudulent, or false acts; violate venue policies; or display threatening, harassing, disruptive, violent, or other unacceptable behavior or speech. Participants who have been removed for the venue for any reason will be disqualified from participating inthe Experience.
GOVERNING LAW
Drawing shall be governed in accordance with the laws of the State of Texas. By accepting the prize awarded by the Drawing, Participants hereby submit to the jurisdiction and venue of the federal and state courts of Texas and waive the right to adjudication in another forum.
